UK Legal Highlights with Sare
An Update on Motor Finance Claims:
On 1 August 2025, the UK Supreme Court handed down a major decision on car finance commission claims. The Court ruled that car dealers and finance brokers don’t owe a fiduciary duty to their customers. That means lenders aren’t on the hook for “secret commission” or civil bribery claims based on those relationships, which had formed the basis of many legal challenges. That said, the Court did find in one case Johnson v FirstRand that there was an unfair relationship. The customer had paid a high interest rate, with over half of it going toward an undisclosed commission, and wasn’t offered any other finance options. The Court said that crossed the line, but made it clear that every case will need to be judged on its own facts. So, while this ruling limits the number of potential claims, it doesn’t close the door.
The Financial Conduct Authority welcomed the decision and is pushing ahead with plans for a redress scheme. A consultation is expected in October, with compensation payments possibly starting in 2026. The total cost to the industry is now expected to be between £9 and £18 billion.

Positive Signals for UK Funders
The Civil Justice Council’s June 2025 report has injected renewed optimism into the litigation funding market. It strongly recommends reversing the Supreme Court’s PACCAR decision, which had cast doubt on many funding agreements by classifying them as Damages-Based Agreements (DBAs). The CJC also calls for a bespoke, light-touch regulatory regime, balancing transparency and consumer protection without stifling access to justice. If adopted, these changes would restore enforceability of key funding models and create a clearer, more stable environment for funders to support mass claims, including in the motor finance space.

Earlier this summer, we had the opportunity to meet with top immigration firms in this country. Through these meetings, we were able to get an inside look at the daily tasks involved in running an immigration firm.
